Code of Ethics for the Patronito Community

1. Introduction: Our Mission and Shared Values

Welcome to the Patronito community. Our mission is to create a global platform where good ideas meet the power of community and where everyone can contribute to positive change. We believe in the power of collaboration, transparency and mutual respect. This Code of Ethics and Community Guidelines (hereinafter referred to as the “Code”) has been created to protect the integrity of this environment and ensure that our platform remains a safe, trustworthy and constructive place for everyone. This document sets out binding rules of conduct for every User of the Platform. By accepting the Terms of Use, you confirm that you have read this Code, understand it and agree to abide by all the rules contained therein. Thank you for helping us build and cultivate a community that we can all be proud of.

2. Binding rules of conduct for all Users

As a User of the Patronito Platform, you agree to abide by the following rules. Violation of these rules may result in the measures described in Section 4 of this Code.

2.1 Compliance with laws and third party rights

You are prohibited from using the Platform for any activity that is illegal or violates the legal rights of others. This includes, but is not limited to:

• Using the Platform to finance illegal activities, including fraud, money laundering or support for terrorism.

• Posting content that violates intellectual property rights (copyrights, trademarks), the right to privacy, the right to protection of personality, or any other rights of third parties.

• Entering into agreements or contracts that are in conflict with applicable laws or your contractual obligations to other entities.

2.2 Prohibition of fraudulent and misleading conduct

Integrity and trust are the foundation of our community. Therefore, it is strictly prohibited to:

• Post information that you know to be materially false, misleading or inaccurate, whether in your user profile, Project description, updates or any other communication on the Platform.

• Materially misrepresent the purpose, scope, risks, progress, or planned use of funds of any Project.

• Impersonate another person or entity, whether real or fictitious.

2.3 Prohibition of harassment, hate speech and offensive content

We create an environment of mutual respect. Any behavior that disrupts the safety and well-being of other Users is unacceptable. It is prohibited to:

• Intimidate, harass, stalk, defame or otherwise violate the privacy and dignity of other Users.

• Post content that is hateful, discriminatory, threatening, obscene, vulgar, pornographic or otherwise offensive.

• Incite violence or hatred against individuals or groups based on their race, ethnicity, religion, gender, sexual orientation, age, disability, or other characteristic.

2.4 Rules against spam and unsolicited communication

The Platform's communication tools are used to support Projects and constructive discussion. It is prohibited to:

• Disseminate unsolicited or unauthorized advertising or promotional materials, spam, or chain letters.

• Abuse Project comments or other communication channels to mass-send irrelevant messages.

2.5 Protecting the integrity of the Platform

To ensure reliable and safe operation of the Platform, it is prohibited to:

• Distribute software viruses, malware or any other code designed to damage, disrupt or limit the functionality of software, hardware or telecommunications equipment.

• Attempt to gain unauthorized access to the systems, data, passwords or other information of the Platform or its Users.

• Bypass any security measures we have put in place to protect the Platform.

• Use any type of automated software or device (including “web crawlers” and “scrapers”) to browse or extract data from the Platform without our express written consent.

• Take any action that imposes an unreasonable or disproportionately large load on our infrastructure or the infrastructure of our third-party providers.

2.6 Prohibition of misuse of personal data

The protection of personal data is our priority. If you gain access to the personal data of other Users within the Platform (for example, as a Guarantor who receives Patrons' data for the purpose of informing about the progress of the project):

• It is strictly prohibited to use this information for any purpose other than that for which it was expressly provided.

• You may use the personal data and contacts of the Patrons that we provide you with exclusively and solely to inform you about how the joint project is developing. Do you want to include these enthusiastic supporters in your own company newsletter for future projects? To do this, you must first request their completely separate and clear consent. Remember that in this case, from a legal point of view, you are acting entirely on your own behalf as an independent “Data Controller” and you bear full and undivided responsibility for the security of their data and for compliance with the law (GDPR).

2.7 Protection of minors and financial responsibility

The Patronito community is here for all good ideas, but with a view to the absolute protection of vulnerable people and the security of all financial transfers, we strictly observe age limits. We consider intentional falsification of age in order to support other people's or run our own projects a gross violation of the elementary trust of the entire community. Such behavior inevitably leads to the immediate blocking of the user account.

3. Specific responsibilities and expectations

For the proper functioning of the Patronito ecosystem, it is crucial that all parties are aware of their roles and responsibilities.

3.1 Obligations of the Guarantor

As a guarantor submitting a grant application through a Project proposal for funding, you accept the following obligations to the Organization and the entire community as part of your contract with the Organization:

• Transparent communication: You commit to regularly, honestly and in a timely manner informing your Patrons about the progress, challenges and any delays of your Project. Communication is key, even when you are delivering bad news.

• Responsible use of resources: You agree to use all funds received from Donations exclusively for the purposes and objectives that you have declared in your Project description.

• Making the best effort: You agree to use a high standard of effort to complete the Project. You acknowledge that this is a commitment to effort, not a guarantee of outcome.

3.2 Patron's Declaration and Responsibility

As a Patron providing a Donation to support the Project, with each Donation you acknowledge and agree to the following:

• Understanding the nature of the Gift: You understand that for legal reasons you are sending your money as a direct donation directly to our Organization. However, with your donation you express a clear wish for which specific project you want to help. From our side, we give you our word that we will safely use your funds in the form of a special-purpose grant for this project, and if this is not possible (for example, for security reasons), we will use them for a project from the same category and location.

• Risk acceptance: You acknowledge that you are supporting a project in its early stages of development. You understand that completion of the Project is not guaranteed and that the timelines provided by the Guarantor are estimates only.

• Responsibility for self-examination: The administering organization carefully reviews each grant application and contractually commits them to using the funds strictly according to the signed Grant Agreement. However, there may be unexpected complications that may not have been apparent at the outset. You acknowledge that it is your responsibility to thoroughly review the Project, its objectives and risks before providing a Gift.

• Respectful communication: You agree that all your communication with Guarantors and other Users will be conducted in a constructive, polite and respectful manner.

4. Enforcement of rules and consequences of violations

To maintain the integrity of the community and the Platform, we reserve the right to enforce this Code.

4.1 Our response to problems

We do not proactively monitor your every move and do not pre-censor your every post (we do not have the capacity for blanket surveillance and are not required by law to do so). However, we are committed to taking absolute and immediate action if anyone reports content to us as illegal or in gross violation of this Code. The decision as to whether a violation has occurred and what action will be taken is at the sole and final discretion of the Organization.

4.2 Possible consequences of a violation

Depending on the severity and repetition of the violation, we may apply one or more of the following measures:

• Warning: Official written warning to the User for violation of the rules.

• Content deletion: Deleting comments, parts of the Project description, or other content that violates this Code.

• Temporary account suspension: Temporary restriction of access to some or all features of the Platform for a specified period of time.

• Permanent account cancellation: Definitive and permanent blocking of the User's access to the Platform. In the event of cancellation of the account due to violation of this Code, all benefits associated with previous use of the platform will expire.

5. Reporting of violations and final provisions

5.1 How to report a violation and your appeal process

Have you come across obvious fraud, racist insults or content that clearly does not belong here on the Platform? Simply report it to us via the warning button on the project or by email to info@patronito.com. We will always assess your report fairly and let you know our decision as soon as possible. Please note that if we remove your created content from the Platform based on a report and you do not agree with this action, you have the full legal right to appeal our decision via our internal system. In the event that we still do not agree, you also have the option of using certified out-of-court dispute settlement bodies in your home country.

5.2 Changes to the Code

We reserve the right to change or update this Code at any time. We will notify you of any material changes via the Platform or by email. By continuing to use the Platform after the effective date of the changes, you agree to the new version of the Code.

5.3 Integration with Terms of Use

This Code of Ethics and Community Guidelines form an integral part of the main Terms of Use of the Patronito Platform. By agreeing to the Terms of Use, you confirm that you have read this Code, fully understand it, and agree to be legally bound by it.
